Terms & Conditions for Almond Cottage


Please read these Terms & Conditions prior to booking with us, by booking with us, you confirm that you and everyone in your party accept these Terms & Conditions and will comply with them.


Deposit

Upon booking Almond Cottage a deposit of 25% of the rental fee is payable to secure your booking, via bank transfer.

If you are booking your holiday less than six weeks in advance, the full amount is due immediately.

We reserve the right to cancel your reservation without refunding your deposit if we do not receive the full balance on time.

Final Payment

The balance of the rental fee falls due not less than six weeks before the start of your holiday. Should payment not be received your booking may be cancelled and the deposit lost.
Cancellation

Any cancellation must be made in writing (email is acceptable).

Cancellation of your booking up to six weeks prior to your holiday will result in the forfeit of the deposit.

Cancellation of your booking between four and six weeks prior to your holiday will result in 50% forfeit of the total rental fee.

Cancellation of your booking between two and four weeks prior to your holiday will result in 75% forfeit of the total rental fee.

Cancellation less than two weeks prior to your holiday will result in the forfeit of the total rental fee.

You are advised to take out holiday insurance to cover this eventuality.

Almond Cottage reserves the right to refuse any booking or to cancel any booking already made subject to refunding any sums you have already paid. The Booker will have no further claim against Almond Cottage.

Injury/Loss

The owner of the property cannot be held responsible for any accident, damage, loss, injury, expense or inconvenience suffered by the hirer or any other person in the party or connected to the party including pets.

Risk Assessments

Risk assessments relating to fire safety etc are included in the welcome pack in the cottage and we strongly encourage you to familiarise yourself with these to ensure your own safety.
This includes details of a fire blanket and fire extinguisher provided in the cottage.

The use of candles or BBQ’s are not permitted.

We ask that when inside the property, guests leave the key in the front door to ensure a fast and safe exit from the cottage should a fire start or the alarms sound.

Smoking

Almond Cottage have a Strict No Smoking policy this includes the use of e-cigarettes within the property.

Electric Cars

Electric cars cannot be re-charged at Almond Cottage. If using an electric car please familiarise yourself with local charging stations prior to arrival as under no circumstances may the domestic power supply be used for this purpose. Please contact us if you have any questions.

Keys/Key Fob

You will receive one set of keys/key fob for the cottage. The set of keys/fob will be left in the property for your arrival. Please ensure keys are returned as found when you depart. Failure to do so or loss of keys and fobs will result extra charges.

Disclosure

Failure to disclose all relevant information or comply with these terms may lead to termination of the contract and loss of booking without a refund.

Damage

The guest agrees to:

Keep the interior of the property in a good clean and tenantable state and condition and not damage or injure the property or any part of it. Failure to do so will result in extra charges, and may lead to termination of the contract and loss of booking without a refund.

Maintaining the property and keep in a good, clean condition of all the contents of the property, and to replace, repair or cleanse any items which become broken or damaged during the term. Report breakages or damage in a timely manner, please call Sarah on 07958 477 778.

Not make any alteration or addition to the property nor to do any redecoration or painting of the property. This includes party decorations using pins, sticky tape or blue tac.

Not do or omit to do anything on or at the property which may be or become a nuisance or annoyance to any other occupiers of the property or owners or occupiers of adjoining or nearby premises or which it may in anyway prejudice the insurance of the property or cause an increase in the premium payable therefore. PLEASE NOTE: noise disturbance of other occupiers within the building and complaints thereof will result is extra charges, and may lead to termination of the contract and loss of booking without a refund.

Not use or occupy the property in anyway whatsoever other than as a private holiday residence for maximum of four persons, excluding infants with prior approval.

Not assign sublet charge or part with or share possession of occupation of the property or any part thereof

Allow the landlord or anyone with the landlords written permission to enter the property at reasonable times of the day to inspect its condition and state of repair and carry out any necessary repairs provided the landlord has given reasonable prior notice (except in emergency)

Subject to the guest paying the rent and performing his/her obligations under this agreement the tenant may peaceably hold and enjoy the property during the term without interruption from the landlord or any person rightfully claiming under or in trust for the landlord

The landlord will insure the property and the contents of the property which belonged the landlord and make a copy of the insurance policy available to the guest.

Arrival & Departure Times

Your cottage will be ready from 4.00 p.m. on your arrival day. The front door is opened with a pin code and once you are in the property a key fob will be located inside the cottage by the front door for you to use (or you can continue to use the code). A code will be provided, a day prior to arrival by text or email. On your departure day, the cottage must be vacated by 10.30 a.m. The cottage must be left clean and tidy as you found it, there are cleaning products and equipment for your use under the sink in the kitchen. All furniture should be returned to the original location. Please ensure all kitchen equipment and utensils are cleaned thoroughly and put away. If the cottage is left in an unsatisfactory condition (checked after you leave), i.e. breakages, not cleaned thoroughly, damage, loss of cottage property and postage of any items left at the cottage. An invoice will be forwarded to you, detailing the cost to put right.

If you are late departing the property, you may be charged a late checkout fee of £10 per hour after 10.30am. Un-arranged late departures can impact on our ability to check arrivals in on time and we respectfully ask that all holidaymakers comply with the check-out time.

Obligations of the Hirer

The number of persons in the party must not exceed the number confirmed on the booking form, which must not be greater than the cottage is designed to accommodate. If the number exceeds the number confirmed on the booking form your booking may be cancelled and you may be asked to leave with no refund made.

The cottage must be left clean and tidy as you found it, there are cleaning products and equipment for your use. All furniture should be returned to the original location. Please ensure all kitchen equipment and utensils are cleaned and put away. If the cottage is left in an unsatisfactory condition (checked after you leave), i.e. breakages, not cleaned thoroughly, damage, loss of cottage property and postage of any items left at the cottage. An invoice will be forwarded to you, detailing the cost to put right.

Please tell us straight away about any problems. We want you and our future guests to have as lovely a time as possible, and we work hard to put anything right immediately. Emergency contact details are in the welcome pack in the cottage.

Please be respectful of immediate neighbours and other residents in the area. Many neighbours are permanent residents and we rely on our guests respecting the peace and quiet environment in communal areas and within the site to continue our business.

We cannot consider compensation for complaints raised after you leave or if you won’t let us try to put things right while you are with us.

Electricity, heating, WI-FI, bed linen and towels are all included. There are no allocated parking spaces, however if it is safe to do so, you can pull over quickly alongside the cottage to load and un-load cars. There are two time restricted parking spaces opposite the cottage which can be used, and free on street parking just a little further down the road and the road opposite the cottage leads to a public car park.

Stag or hen party groups and unaccompanied teenagers are not permitted at the property.

Please check the cottage thoroughly before departure, as lost property can only be returned to the owner if they are willing to pay postage costs. Any items unclaimed after one week will be disposed of. Any proceeds will go to a charity of our choice.

The Proprietor

The proprietors reserve the right to refuse any booking or to cancel any bookings already made subject to refunding any sums you have paid without further liability on your behalf.
The proprietors reserve the right to terminate your stay if you, or any member or members of your party, are believed to be causing a nuisance or are not treating the property with due respect.

The proprietors shall not be liable to you, or any other member of your party, for any loss or damage to you or to your property however caused.

The proprietors reserve the right to enter the property during your stay.

If for any reason beyond the proprietors’ control the property is not available on the date booked (owing to fire damage for example), or the property is unsuitable for holiday letting, all rent and charges paid in advance by the applicants will be refunded in full, but the applicants shall have no further claim against the proprietors.

The proprietors reserve the right to cancel any booking or terminate the tenancy, without prejudice to the other rights and remedies of the proprietors, if it subsequently transpires that any of these conditions have not been observed.

The proprietors reserve the right to change, e.g. through refurbishment, details as previously advertised.

Overseas Guests

Overseas guests may pay in Sterling.. Any charges for payments from overseas will be passed on to the guest.

Children

All children staying at the property must be accompanied by their parents or legal guardians at all times. Do not leave children unattended.

There is a cot & high chair available upon request but all baby bedding and linen are NOT provided.

Pets

We are not able to welcome pets to our cottage. We have a strict no pet policy.

General Conditions

The tenancy confers upon the Tenants the right to occupy for a holiday within the meaning of Schedule 1, Paragraph 9 of the Housing Act 1988.
The person who completes the booking form certifies that: a) he or she is authorised to agree the booking conditions on behalf of all persons included on the booking form, including those substituted or added at a later date; b) the signatory is over eighteen years of age and a member of the party intending to occupy the property; and c) agrees to take responsibility for the party occupying the property.

English law shall govern the validity, construction and performance of this Agreement. If any term or provision in these booking conditions shall in whole or in part be held to any extent to be unenforceable under any enactment or rule of law that term or provision or part shall to that extent be deemed not to form part of this agreement and the enforceability of the remainder of this agreement shall not be affected.

These booking conditions replace and supercede all previous booking conditions.

Covid-19 Policies

Please ensure all guests understand guidelines in England at the time of travelling as the situation is changing on a regular basis. Please refer to https://www.gov.uk/coronavirus for the latest guidance.

We strongly recommend that you take out holiday insurance to cover you if you contract Covid-19 before or during your stay as our regular cancellation policy applies to all bookings.

Data Protection

Any personal data you give to us will be processed in accordance with the law. Any information you provide us with ie names, addresses, phone details, email will only be used by office staff to contact you regarding business. We will not share it with an associated business or with third parties and will only release the details we have if the law requires us to do so. We will only retain your data whilst we still need it. Please ask us if you would like further information about how long we will keep your data. If you have any concerns about your personal data, please speak to us. You also have the right to complain to the Information Commissioner (https://ico.org.uk).
